Dear Minto Management,
I am writing as a resident of High Park Village whose tenancy predates July 2, 2008. I am aware that the Weighted Useful Life of the Above Guideline Increase (AGI) Rent Order TSL-12698, which took effect on July 1, 2008, has come to a conclusion with its Reduction Date having occurred on June 30, 2023.
In compliance with the Residential Tenancies Act regulation s. 129, O. Reg 516/06 s.38, I am hereby notifying you of my intent to decrease my current rent amount by 0.7%. I will initiate this rent reduction on the anniversary month of my tenancy, as it was prior to January 1, 2020, and this reduction will remain in effect for all subsequent months.
Once my rent is reduced by 0.7%, this will become my new rental amount until the next legal increase which may result from the application of a Provincial Guideline Increase and/or a result of any AGI(s) later approved by the Landlord and Tenant Board. These legal increases will be applied, in the standard manner, to the rent amount already adjusted by the 0.7% reduction. This rent reduction is not time-limited and any future legal increase will not reverse or negate the 0.7% reduction that will be applied to my rent.
Upon its effective date, this rent reduction should be automatically applied to my account, without further intervention on my behalf, and applicable to any automatic withdrawals previously arranged. The revised amount, reflecting the 0.7% decrease, should also be correctly displayed on my RentCafe statements.
Kindly respond to confirm my understanding of the above, my eligibility for this rent reduction, and provide the requested information detailed below:
- Provide your confirmation that my interpretation of the rent reduction process is accurate.
- Verify my eligibility for the 0.7% reduction of my rent.
- Inform me of the date on which my rent reduction will become effective.
- Inform me of the exact legal amount my rent will be, after applying the 0.7% decrease and excluding any AGI(s) that are not yet settled with the Landlord and Tenant Board.
- Provide your confirmation that, upon its effective date, the 0.7% rent reduction will be automatically applied to my account without my intervention and will be applicable to any automatic withdrawals previously arranged, and that the revised rental amount will be correctly displayed on my RentCafe statements.
- Provide a breakdown of any currently unsettled AGI(s), presented as individual line items, including both their respective amounts and application numbers. This will allow me to make an informed decision about whether to voluntarily incorporate them into my monthly rental payments to potentially avoid lump sum retroactive payments when, and if, I receive a written Rent Order permitting any Above Guideline Increases awarded to Minto at a Merits Hearing.
